(1) Except
for the purposes of auditing or upon an order of a Court, no public official is
permitted to disclose to any third party, whether for personal gain or for any
other motive, confidential or proprietary commercial information obtained by
virtue of his involvement in, or contact with officials involved in,
procurement proceedings or the planning of procurement.
(2) No
information relating to the examination, evaluation and comparison of bids
shall be disclosed to bidders or to any other person not involved officially in
the examination, evaluation or comparison of bids or in the decision on which
bid should be accepted, except as provided for in section 37
of the Act.
