(1) Where
the contract is terminated for convenience, the public body shall authorise
payment for the value of the work done, goods or services supplied, the
reasonable cost of removal of equipment, repatriation of the supplier’s
personnel employed solely on the works, and the supplier’s costs of protecting
and securing the works, where applicable, and less any advance payment received
by the contractor up to the date of the notice of termination.
(2) For
any remaining goods, the public body may elect –
(a) to have any portion
completed and delivered at the contract terms and prices; or
(b) to cancel the
remainder and pay to the supplier an agreed amount for partially completed
goods and services and for materials and parts previously procured by the
supplier.
